Welcome to The Kitchen Book. These Terms of Service ("Terms") govern your access to and use of the websites and services at thekitchenbook.com and creator.thekitchenbook.com (together, the "Services"), operated by The Kitchen Book ("The Kitchen Book," "we," "us," or "our"). Please read them carefully.
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
The Kitchen Book provides tools that help recipe creators turn their published recipes into a branded online "Kitchen," where their audience can browse, save, print, and support their work through features such as memberships, printable recipes, comments, and purchases. We may add, change, or remove features over time.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
You own your content. As between you and The Kitchen Book, you retain all rights to the recipes, images, text, branding, and other materials you provide or connect ("Creator Content"). By using the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for formatting and display), and publish your Creator Content solely as needed to operate and provide the Services, including building and displaying your Kitchen and its printable and shareable formats.
You represent and warrant that you own or have the necessary rights to your Creator Content, and that it does not infringe the rights of any third party or violate any law. You are solely responsible for your Creator Content and for having the rights to any recipes, photographs, or other materials you connect or upload.

Some features let visitors purchase printable recipes or other products, or join a creator's memberships. Prices, availability, and fees are shown at the point of purchase and may change. Payments are handled by our third-party payment processors, and by making a purchase you also agree to their terms. Except as required by law or as expressly stated at purchase, sales are final.
Where the Services enable creators to earn from their audience, the applicable fees, revenue share, and payout terms will be described to the creator within the Services. We may update these terms on a going-forward basis with notice.
The Services, including our software, design, branding, and content we create (but excluding Creator Content and third-party content), are owned by The Kitchen Book and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services as intended. You may not copy, modify, distribute, or create derivative works of the Services except as permitted by these Terms.
The Services integrate with and link to third-party services, such as the platforms where you publish, sign-in providers, and payment processors. We are not responsible for third-party services, and your use of them is governed by their own terms and policies.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that automated recipe extraction will always be accurate or complete.
To the fullest extent permitted by law, The Kitchen Book and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred U.S. dollars.
You agree to indemnify and hold harmless The Kitchen Book from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Creator Content, your use of the Services, or your violation of these Terms or the rights of any third party.
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, and limitations of liability.
These Terms are governed by the laws of the United States and the state in which The Kitchen Book operates, without regard to conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless applicable law requires otherwise.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and if changes are material we will provide additional notice where appropriate. Your continued use of the Services after an update means you accept the revised Terms.
